:(My neigbours dog on occasion will bite, I know he has an ear problem at the moment- it all came to a head on Sunday when he bit a friend who then kicked the dog down stairs and proceeded to hit the dog. what should we do and why does he do this, very worried German Shephard Fan

There's a lot of reasone why a dog may bite. It may be sick and in pain, as you suggest. It may be badly trained and showing territorial aggression. It may be a cowardly fear biter. It's impossible to tell from the little bit of information you provided.
It's the owner's responsibility to protect their dog from injury and harm, and to protect the public from their dog. It sounds like they're doing a prety rotten job in both areas.
In the meanwhile, you have to take whatever measures are necessary to protect yourself from this dog.
